In September 1989, my girlfriend came and told me she was pregnant and that I was the father. On July 1, 1990 a baby girl was born. In 1993 the mother took me to court to establish child support. As I believed I was the father (no idea that the mother was sleeping around) I showed up for court and signed papers to pay child support.  

I was not present at the birt h but saw her about three days after she was born, and stayed with her and the mother for about a week. In November 2000, the girl, now 10 years old was at my house, she asked me “who is Uncle Brian, is he really my uncle.” She stated, my mother said, “I was named after him.” I had a DNA test talken November 16th, 2000. Tests came back that I was exlcuded from paternity. We went to court in Long Beach, California, on May 15, 2001 to have the paternity set aside.

The commisioner that was hearing the case was almost apologetic, his statement, ” until legislature is changed, my hands are tied, then denied the request to set aside paternity. From August to November 19th, 2000 the child spent every other weekend with myself and my wife, this was on the insistence of the mother.

I have not spent more than 30 days in 11 year with the child and yet the law says that I have held her out as my own. I am now requried to pay $589 per month plus approximatewly $20,000 in arrearages. Totallly unfair, DNA should can free a person in other things it should certainly work here.
